Din kienet wahda mill-mozzjonijiet li approvaw il-membri tal-EPOU fil-Laqgha Generali Annwali li saret nhar it-Tlieta 6 t’ Ottubru 2009, fejn gie elett il-Kumitat Ezekutiv ghas-sena 2009/2010.
Il-Union ilha zmien titlob lill-Enemalta, bhala s-sid, u resqet rapporti formali bir-ritratti lill-OHSA u l-MEPA biex jitnaqqas dan l-inkonvenjent. L-unika twegiba waslet mill-OHSA li sostnew li ma tistax tintervjeni ghax fejn hemm it-trab mahzun mhux qed isir xoghol u it-terrapien li fadal hu ta’ xoghol mill-passat. Madanakollu l-haddiema ta’ Delimara ta’ spiss jinnutaw trakkijiet u ‘ready mixes’ dehlin u hergin bil-materjal.
Policy importanti approvata issa ser tiddetermina kif il-union ser timxi fil-futur meta l-Korporazzjoni timpjega ufficcjali godda kontra l-Ftehim Kolletiv. Il-mozzjoni giet approvata, wara li ikkundannat il-ksur persistenti tal-Ligi u l-Ftehim Kollettiv mill-Enemalta fejn jirrigwardjaw mili ta’ posts godda,. Il-mozzjoni tghid hekk;
Titlob lill-Kumitat il-ġdid biex mal-ewwel vakanza ta’ PE’s li tiġi ppublikata wara din il-LGA, kemm internament kif ukoll esternament, fejn il- management ma jirrispettax il-FK, tinforma lill- management li l-membri ta’ din il-union mhux ser jikkoperaw mal-persuna appuntata. Il-union tkompli b’din il-pozizzjoni ghal kull post fejn il-FK ma jiġix irrispettat. ‘
Fir-rigward ta’ mili ta’ vakanzi, l-laqgha talbet li dawk kollha li jokkupaw skali ‘l fuq minn skala 9 ikollhom grad Universitarju u mhux kif qed isir bhalissa, li jinhargu vakanzi interni qabel ma l-management ifittex li jimpjega persuni fi gradi manigerjali ‘on secondement’ u u ma jintalbux pri-rekwiziti li juru bic-car li l-post vakanti hu mfassal ghal persuna partikolari.
Il-laqgha ukoll ikkundannat theddid li jsir minn wiehed mic-Chief Managers tal-Korporazzjoni kull meta l-Union tordna azzjoni industrijali. Dan minkejja li l-Union dejjem timxi mal-provvedimenti tal-Ligi u tal-Ftehim Kolettiv. Il-membri talbu lis-CEO jiehu passi biex ic-Chief Managers jirrispettaw il-Ligi u l-Ftehim Kolletiv.
Finalment, il-laqgha talbet ukoll li l-Korporazzjoni tapprezza u tifhem l-inkwiet u l-incertezza li ghaddejjin minnu l-haddiema fil-Generation u d-Divizjoni tal-Petroleum minhabba l-gheluq tal-power station tal-Marsa, kif ukoll dwar il-‘ commercialization’ rispettivament. Il-Korporazzjoni ghanda tkellem lil dawn l-ufficcjali u tassigurahom dwar il-futur u l-kundizzjonijiet tax-xoghol taghhom.
POLLUTED AIR AT DELIMARA, OFFICERS EMPLYED ILLEGALY TO BE BOYCOTTED, AND THREATS DURING INDISTRIAL ACTION
‘The professionals, members of the EPOU urge Enemalta Corporation, the OHSA and MEPA to quickly take steps against the illegal concrete batching plant, and the every growing sand and dust mountain setup by a local contractor, found just outside the Power Station at Delimara. This dust is causing a lot of inconvenience and respiratory problems to the employees’.
This was just one of the motions approved by the EPOU members during the Annual General Meeting held on Tuesday 6th October 2009. The AGM also elected its Union officials .
The Union has long been requesting the Corporation, as its employer, and even submitted formal claims accompanied by photographs to the OHSA and MEPA last July, to have the inconvenience removed. The only reply was received from the OHSA who insisted that they could not intervene since in its view no work being carried out where the sand was being kept by the contractor, but also, since the OHSA opined that the dust originated from past works. In spite of this reply, Delimara workers frequently observe open trucks and ready mix trucks entering and leaving , loaded with material.
Another important policy approved will now determine how the Union will proceed when the Corporation employs new officials in breach of the Collective Agreement. The motion approved, condemned the Corporations persistent braches in the Law and the Collective agreement where this involves filling of vacant posts, and ‘As soon as the Corporation issues an internal or external vacancy notice in breach of the Collective Agreement, the AGM requests the newly elected committee to inform the Management that it will not be cooperating with the appointed person and to make the public and thus potential applicants aware of this.’
Also with regards to filling of vacancies, Management was requested to refrain from the present practice of appointing persons without a University degree in grades higher than scale 9. Management was also asked not to employ managers ‘on secondment’ without first giving the Corporation’s officers the opportunity to fill the post, and that such vacancy notices should not be ‘tailor made’.
The AGM also condemned the threats made by one of the Corporation’s Senior Chiefs whenever the Union is constrained to call industrial action, even though these actions are in accordance with the Law and the Collective Agreement, and asked the CEO to take the necessary steps to have the Chief Managers respect the Law and the Collective Agreement.
Finally the Corporation was asked to appreciate and understand the uncertainty and worry being experienced by the officers in the Generation Section, and those at the Petroleum Division in view of the planned shutting down of the Marsa Power Station, and the commercialisation of the Petroleum Division. The Corporation was asked to approach these employees and set their minds at rest on their future and conditions of work.
